Wading again into the murky policy surrounding habeas petitions, the U.S. Supreme Court on Wednesday delivered a win for prisoners trying to revive appeals of post-conviction suits in federal court.
The Court ruled 7-2 that petitioners whose federal habeas claims are thrown out due to procedural errors can refile without violating rules against “second or successive” petitions.
