A police officer was not justified in stopping a man he thought to be another man on the basis of a racial description, the Pennsylvania Superior Court has ruled. The man the officer stopped was arrested, tried and convicted for driving under the influence. But the Pennsylvania Superior Court said the stop was invalid and that all evidence garnered from it should have been suppressed.
