Six years ago, attorney William Farrer won a $4.75 million judgment in front of Judge Leslie Tchaikovsky. But the bankrupt defendant soon discovered Farrer's firm had offered a job to Tchaikovsky's law clerk, unbeknownst to Farrer. The verdict was overturned and Farrer's firm sued for malpractice. The saga led the 9th U.S. Circuit Court of Appeals to find that judges and clerks, and not law firms, bear the burden of maintaining the appearance of impartiality.
