The U.S. Patent and Trademark Office (PTO) has proposed revising its patent re-examination process by creating an optional inter partes proceeding, the agency announced April 6 [www.uspto.gov.]
The new practice rules implement the provisions of the American Inventors Protection Act of 1999 with regard to both inter partes and ex parte reexamination.
