Can public information be too public? Judges seem to think so. In December, federal judges refused to have their finances published on the Net, and the U.S. Supreme Court theoretically approved a state's suppression of its arrest records. "One can read these two cases as the opening salvo of a battle," says David Smallman, ex-chair of the ABA media law committee, "between those who think the First Amendment offers an overriding right of access and those who believe it's up to the state" to protect privacy.
