A Nassau County, N.Y. Family Court judge has extended the scope of derivative neglect to include afterborn children.

Judge Richard Lawrence, in D.S.S. obo W.H. v. R.H., N99-560, ruled that a provision of the Family Court Act, �1046(a)(i), which states that proof of neglect of one child creates evidence of neglect of another child in the same family, may be extended even to cover children who are born after the initial determination.
