In a pained decision sure to stir up victims’ rights activists and blacken the eye of the Texas Attorney General’s office, Houston U.S. District Judge David Hittner ordered the release of a death row prisoner in a March 1 decision.

Hittner ordered that Calvin Jerold Burdine be released from prison within five days of his order because the AG’s office missed a court-ordered deadline to retry him.
