The 5th U.S. Circuit Court of Appeals affirmed a lower-court victory by talk-show host Oprah Winfrey on Wednesday, ruling that a jury had correctly found that her television program had not falsely disparaged the Texas beef industry.
Cactus Feeders Inc. and other beef-industry plaintiffs challenged the Amarillo jury’s 1998 verdict. The cattlemen had alleged violations of the 1995 Texas False Disparagement of Perishable Food Products Act and sought damages arising from alleged business disparagement, defamation and negligence.
