For the fourth time in as many years, DuPont is asking Miami-Dade Circuit Judge Amy Steele Donner to step down from hearing any litigation against the chemical giant for damages caused to crops by the fungicide Benlate.

The most recent request, filed Jan. 28, says Donner has shown continued hostility toward DuPont and has exhibited “disdain” for the company’s financial and legal resources. It asks that she recuse herself from hearing the 17 other Benlate cases that have yet to go to trial. A hearing on the motion is scheduled for Feb. 10.
