The New York Civil Liberties Union is seeking to file an amicus curiae brief in support of attorney Andrew F. Capoccia, an Albany area practitioner embroiled in a battle with the Third Department Committee on Professional Standards. Capoccia, who runs a high-volume debt-reduction business with six offices in New York State and one each in Massachusetts and New Jersey, has been sanctioned to the tune of $1.5 million by judges who have accused him of repeatedly filing frivolous and meritless lawsuits against creditors and their representatives. The disciplinary committee is seeking to have Capoccia suspended or disbarred as a result of those sanctions, even though they are being appealed. Capoccia and his allies claim the upstate legal establishment is intent on forcing him out of business before he has an opportunity to prove that the sanctions are unwarranted. He portrays himself as a champion of underdog debtors often at the mercy of predatory lenders and credit card companies.
