Beasley asked a lower court to reopen the cases after finding "piles of unopened mail, summary judgment motions, preclusion orders" and other legal documents attorney Thomas W. Smith had allegedly hidden. Beasley said Smith's depression led him to abandon cases by doing things such as failing to respond to summary judgment motions.

The state Supreme Court has refused to hear appeals in cases Philadelphia Common Pleas Court Administrative Judge John W. Herron reopened last year because of the “derailment” of the cases by a former Beasley Casey & Erbstein attorney.
