All California workers are covered by regulations aimed at reducing repetitive-motion injuries, the Third District Court of Appeal held Friday. The Sacramento appellate panel struck down a Cal-OSHA provision that exempted small businesses of nine employees or fewer from following state ergonomic guidelines.
Upholding a portion of a Sacramento trial court opinion and keeping most of a 1997 worplace-safety regulation intact, the appeal panel found that a small-business exemption was inconsistent with the statutory mandate to minimize repetitive strain injuries in the workplace.
