San Francisco Superior Court Judge David Garcia has tentatively decided to throw out the case, and he expressed further skepticism during a hearing Thursday.

The plaintiff, Marc Kasky, has sued the Beaverton, Ore.-based company, alleging that Nike fraudulently induced California residents into buying Nike products made by exploited workers in Nike’s Asian factories. Kasky says the company deceived the public when, in press releases and other statements to the media, it denied mistreating Asian workers.
