As Eastern District JudgeNina Gershon weighs whether to grant the Brooklyn Museum of Art’s requestto block Mayor Giuliani’s campaign against the “Sensation” exhibition,the issue of whether her court should decide the matter is very much alive.

At the close of an Oct. 8hearing, Judge Gershon asked both sides to file additional arguments onwhether she should abstain from exercising jurisdiction and defer to astate eviction action filed by the City in Kings County Supreme Court.
