Lawyers from Philadelphia's Fisher Schumacher & Zucker recently helped the ice-cream truck franchiser hold a hard line against franchisees who sued in federal court in New York for the right to sell ice cream made with a cheaper mix. The plaintiffs allege that Mister Softee, by requiring franchisees to buy ice-cream mix from authorized suppliers, is forcing them into a "tying" arrangement forbidden by the Sherman Antitrust Act.
