When Royal Caribbean Cruises Ltd. agreed to plead guilty to an array offederal environmental law offenses this summer, the U.S. governmentextracted an unusual concession from company defense attorneys.As a condition for resolving the case, Royal Caribbean’s lawyers had torelinquish the bulk of the notes they compiled during interviews withcompany employees, as well as copies of reports from experts andconsultants who helped defend the case.

It was, in effect, a waiver of attorney-client privilege.The company, through Miami lawyer Norman Moscowitz, one of severallawyers who represented Royal Caribbean, declined to discuss theprovisions.
