Day trader Mark O. Barton’s shooting rampage in Atlanta last Thursday occurred just a week before the ABA comes to town to hear, among other things, a debate on gun suits. Though no details had emerged late Friday of any possibile liability surrounding the shootings in Buckhead that left as many as nine dead, those involved in gun suits say the massacre will likely be discussed at the ABA’s August 9 meeting. In addition, Atlanta appears to be the first city to schedule a court hearing on a gun suit filed by the city under Georgia’s product liability laws, accusing the gun industry of negligent product design and failure to provide adequate safety devices and warnings. The hearing is set for September 13; Smith & Wesson and other 16 gun manufacturer defendants will argue for a motion to dismiss.
