Punitive damages may be awarded under the Survivor’s Act even if there is no award of compensatory damages, the stateSupreme Court ruled Tuesday in a precedent-setting case.
In Harold E. Smith v. Alan Whitaker, et al., A-15, thejustices upheld $1.25 million in punitive damages awarded to thesurvivors of a Port Norris, Cumberland County, woman killed in acar accident.
