A Georgia businessman targeted for deportation despite his status as a permanent U.S. resident has lost another round before the 11th U.S. Circuit Court of Appeals. Richardson, 33, has been held in a Miami detention facility since 1997, when immigration officials arrested him as he returned from a trip to his native Haiti. Although he has lived in the United States since he was 2, Richardson is classified as an "arriving alien" because of a drug conviction.

The court concluded last week for the second time in six months that itcannot consider his habeas corpus petition. A two-member panel said a1996 immigration law limits its jurisdiction, at least until the Boardof Immigration Appeals issues a final order of removal.
