Phil Hardberger, chief justice of the Fourth Court of Appeals in San Antonio, Texas, authored such a scathing law review article in St Mary’s Law Journal that the publisher sold out of hardcover editions. “Juries Under Siege” contends that business interests, angered by the Texas Supreme Court’s liberal bent in the 1980′s, united to secure the election of “conservative activist” judges. The article lists case after case involving maimed and aggrieved plaintiffs who won damages at trial, kept it on appeal, but then lost some or all of it at the hands of judges Thomas Philips and Nathan Hecht of the Supreme Court. The Texas Bar Foundation selected “Juries under Siege” as best law review of 1999 — an act which provoked many foundation members.
