Charles F. Gibbs and Robert W. Sheehan, who left New York’s Breed, Abbott & Morgan in 1991 to become partners at Chadbourne & Parke, were found to have breached fiduciary duties owed to their former firm. Breed Morgan suffered $1.9 million in lost billings after the partners bailed with many members of the trusts and estates department. Justice Herman Cahn ruled that the profits they earned while at Breed Abbot, which they claim are owed to them, must be offset by Breed Abbott’s damages. Gibbs’ encouragement of Sheehan to leave, and the information both partners gave to Chadbourne that resulted in the hiring away of Breed Morgan lawyers, were deemed acts of impropriety sufficient to make them liable for Breed Morgan’s losses.
