The Sixth Appellate District denied a petition. The court held that the recent passage of Proposition 59 did not alter or abrogate the “mental processes” principle, which precludes judicial inquiry into the motivation or mental processes of legislators in enacting legislation.

The City of San Jose passed an ordinance that prohibited operation of card rooms between 2:00 a.m. and 6:00 a.m., and backline betting. Sutter’s Place, Inc., operated a card room under a permit issued by the City.
