MIAMI � David O. Markus, whose blog “The Southern District of Florida blog” reports on federal cases of interest in South Florida, will no longer be reporting on one of the biggest ongoing cases in the area, the so-called “Liberty City Seven” case. That’s because Markus feels he is subject to a wide-ranging gag order imposed by U.S. District Judge Joan Lenard, which Markus is appealing. Seven Miami men are charged with trying to join up with al-Qaida in plots to bomb Chicago’s Sears Tower and the Miami FBI building. Along with the case of Jose Padilla, the so-called Liberty Seven case was one of the most high-profile terrorism cases in the country and the mistrial was considered a huge blow to federal prosecutors and the Justice Department. The U.S. Attorney’s Office is retrying the terrorism case, which resulted in a mistrial last month. One of the seven, however, was acquitted by jurors, but then swept away by U.S. Immigration authorities. Preparing for a retrial against the six, Lenard issued a blanket gag order last week, which she stated applies to acquitted defendant Lyglenson Lemorin, who is now a witness for the defense, as well as to his court-appointed lawyer, Joel DeFabio, and to “Mr. DeFabio’s agents as well.” That defendant’s lawyer, Joel DeFabio, hired Markus to fight the gag order, as he wants to speak to the press about what has happened to his client, Lyglenson Lemorin. Markus is filing an appeal with the 11th Circuit Court of Appeals on First Amendment grounds. In the meantime, Markus said on his blog that he will no longer blog about the case. “Because I am now one of DeFabio’s agents, I take it that I cannot speak about the case. I filed a motion to clarify that today, but until that is ruled on, I don’t think I will be posting about the case.” Another blog in town, the Justice Building blog, which reports on state court issues, took up where Markus left off and solicited comments on the Liberty Seven case. “So, Mr. Markus, being silences for the foreseeable future, your humble blogger and servant becomes Liberty’s Last Champion,” write the Justice Building blogger, adding that “Lenard issued a ‘gag order’ that included Queen Elizabeth, Janet Reno, Sylvester Stallone, ‘every resident in any zip code that begins with 3…’ most of the Lower Parliament of New Zealand, as well as to victorious Liberty City Seven lawyer Joel DeFabio ‘and his agents.’ “ That blogger might feel more immune from the gag order since his identity is anonymous.
