All of the sudden, attorney general nominee Michael Mukasey is finding himself inundated in paperwork. Last week, members of the Senate Judiciary Committee submitted 90 pages chock-full of follow-up questions and comments after his confirmation hearings Oct. 17-18. That’s in addition to at least three other letters senators mailed him separately after his hearings, which contained mixed reviews of his answers on the expanse of presidential powers and the use of simulated drowning by CIA officers. Not surprisingly, those topics featured prominently in the questions. For example, committee Chairman Patrick Leahy (D-Vt.) asks, “If you are not willing to declare any of these [interrogation] tactics to be unlawful at this time, what type of further information and analysis will you need in order to make such a determination?” William Barr, Verizon’s general counsel and former attorney general under President George H.W. Bush, remembers “voluminous” follow-up questions after his confirmation hearings, as well. Barr calls the nearly 100 pages Mukasey will pore over “hefty” but “probably not unprecedented.”
