San Francisco’s Hersh & Hersh has announced the filing of a class action lawsuit on behalf of Amber Spitzer and other parents who purchased defective cribs under Simplicity and Graco labels. The U.S. Consumer Product Safety Commission and the Reading, Pa.-based Simplicity Inc. issued a recall of cribs under the Simplicity and Graco trademark because they can allow a portion of the mattress to fall, posing a suffocation hazard. Fourteen incidents have been reported, according to the commission. Simplicity has offered free retrofit kits, but the class action complaint says the remedy is insufficient. The cribs have led to deaths of three infants, entrapment of seven others and at least 55 other incidents of hardware failure, according to Hersh & Hersh.
