The San Diego City Attorney’s Office has sued Willkie Farr & Gallagher for $29.3 million related to the law firm’s handling of an investigation into the city’s underfunded pension plan. San Diego City Attorney Michael Aguirre filed two lawsuits Aug. 7, one on behalf of the city and another on behalf of California residents, in California Superior Court, San Diego County. The lawsuits allege fraud, negligence and violations of the California’s False Claims Act. The San Diego City Attorney’s Office claims that Willkie Farr attorneys duplicated much of the investigation work already conducted by Kroll Inc. into the pension fund’s $2 billion shortfall, that it knowingly overbilled the city by some $9.7 million and that it breached its agreement with the city regarding the work it would provide. The total damages claimed are triple the actual damages. Willkie Far did not return a phone call seeking comment. Bryan C. Vess is outside counsel for the San Diego City Attorney’s Office.
