The Section of Intellectual Property Law (ABA-IPL) advocates for enlightened intellectual property laws and brings balanced insights to policymakers. During the new bar year, the section will file amicus briefs on cutting-edge issues in the courts, advise Congress on legislation and advocate before administrative agencies. These activities are rooted in the work of more than 60 substantive committees and numerous individual task forces and are complemented by a growing portfolio of forward-thinking publications, legal education programs and forums. The section is the oldest substantive membership group within the American Bar Association and the largest intellectual property organization in the world. During the past year, the section council recommended that the ABA file five amicus briefs four to the U.S. Supreme Court and one regarding the issue of attorney-client privilege to the U.S. Court of Appeals for the Federal Circuit. Through these filings, the section successfully harnessed the powerful voice of the ABA to speak on critical legal issues. The section’s committees and task forces will continue to monitor the courts and develop policy for use in advising the courts in pivotal cases. Amid a growing perception that the domestic patent laws are in need of reform to meet the demands of 21st century, Congress has addressed major patent reforms. Two years ago, congressional leaders asked the section to advise and assist in this effort, resulting in the Section White Paper: Agenda for 21st Century Patent Reform. This effort is ongoing, and the section continues to provide advice regarding new comprehensive reform legislation in updates to the white paper. The section will continue to assist in those efforts as well as in other substantive intellectual property topics that Congress may consider. In exercising its powerful voice, the section regularly submits comments affecting copyright, trademark and patent laws to the executive branch including those on Draft Strategic Plan for FY2007-2012, and proposed trademark rules, proposed patent rules changes and comments to the U.S. Patent and Trademark Office on proposed changes to the information disclosure statement rules. The section works toward full and fair participation by all lawyers in intellectual property practice. The section encourages young lawyers to participate in section activities, and remains committed to the ABA’s Goal IX to increase diversity in our practice. Pamela Banner Krupka is chair-elect of the Section of Intellectual Property Law. She focuses her practice on patent law. She practices at Krupka Law Group in Los Angeles.
