A Manhattan judge’s dismissal of an economics consulting firm’s estimate of the cost of payments under a 1998 tobacco settlement has been reversed by the New York Appellate Division, 1st Department.
The firm had been selected under the settlement to determine whether the 45 cigarette makers that participated in the accord were entitled to a reduction in their payments because they had lost market share to companies that did not sign the pact.
