Reprimand appealability The article “No recourse for bash from bench: In 7th Circuit, lawyer can’t appeal judge’s critique” [NLJ, May 14] identifies only the 3d, 5th, 9th and District of Columbia U.S. circuit courts of appeals as holding that the reprimand of an attorney is appealable, even if not accompanied by monetary sanctions. This list is incomplete, however. The 10th Circuit joined the 5th, 9th, and D.C. circuits in 2003, in Butler v. Biocore Medical Technologies Inc., 348 F.3d 1163, 1168 (10th Cir. 2003). This should have been clear because the 7th Circuit’s opinion cites Butler. Additionally, although the article identifies the decision as a “break,” the opinion itself says that the court is reaffirming its own earlier decisions, citing Crews Assoc. Inc. v. U.S., 458 F.3d 674, 677 (7th Cir. 2006), and Clark Equipment Co. v. Lift Parts Manufacturing Co. Inc., 972 F.2d 817, 820 (7th Cir. 1992).
