Warren Havens hired Patton Boggs in 1999 to defend him in a fee dispute with his former lawyers and to file a legal-malpractice counterclaim. But when Havens didn’t get the result he wanted, he sued Patton Boggs and former Patton Boggs partner Steven Schneebaum for professional negligence and breach of contract, seeking more than $10 million in damages. Last week, U.S District Judge Henry Kennedy Jr. dismissed the case, finding that Haven’s complaint was filed after the three-year statute of limitations had expired. “We are pleased by the court’s soundly reasoned decision dismissing the action,” says Benjamin Chew, a partner at Patton Boggs who handled the case. In his June 2005 complaint, Havens alleged that Patton Boggs lawyers “made various mistakes, errors of judgment and/or failures to competently perform the services” for which they were hired. Schneebaum represented Havens beginning in 1999, after Lukas, Nace, Gutierrez & Sachs sued Havens and his tech company, Sun Mobile & Data Inc. But by May 2000, Havens was unhappy with Patton Boggs and replaced the firm. Havens later settled with Lukas, Nace, though the terms remain confidential. Havens’ latest attorney, Matthew Simmons of Simmons & Associates, did not return calls.
