L.A. LAWYER NAMED TO NINTH CIRCUIT As expected, President Bush has nominated L.A. business lawyer Milan Smith Jr. to the Ninth Circuit. Tuesday’s nomination means Bush has put forth nominees for the circuit’s four open seats. The others are filibustered Idaho ranching and mining lobbyist William Myers, Idaho state court Judge N. Randy Smith, and Sandra Ikuta, general counsel for the California Resources Agency — and a former O’Melveny & Myers partner — who was nominated last week. Smith, 63, is a founding partner of Smith Crane Robinson & Parker, a former member of the state Fair Employment and Housing Commission, and the brother of Gordon Smith, a Republican senator from Oregon. In November, as Smith was undergoing a standard background check ahead of the nomination, he told The Recorder that he’d been nominated some years ago by both Sen. Orrin Hatch, R-Utah, and Sen. Barbara Boxer, D-Calif. Boxer had become aware of the circumstances of Smith’s departure from the Fair Employment and Housing Commission in 1991, Smith said. He stepped down in protest after then-Gov. Pete Wilson vetoed a bill that would have given the commission power to award compensation to victims of sex harassment. � Justin Scheck
