Henry Saad, the Michigan state appeals judge and long-standing nominee to the U.S. Court of Appeals for the 6th Circuit, pulled his name from contention last week after waiting four-and-a-half years to be confirmed. In an interview, Saad said he decided to stand down after it became clear his nomination was not going to move. He did so now, he said, in order to give other candidates time to take his place before the crush of election-year politics. “I just know the inevitability is that my nomination is not going to proceed to confirmation, and the timing is such that I would be delighted if in my stepping aside there were other qualified jurists who were nominated,” he said. Saad pointed to his friendship with former Michigan Sen. Spencer Abraham as a main reason his nomination has been opposed by the state’s two Democratic senators, Carl Levin and Debbie Stabenow. Levin had accused Abraham, a Republican, of holding up President Bill Clinton’s nominees to the circuit when Abraham represented the state. But Saad may also have sabotaged his own chances when he wrote an e-mail critical of Stabenow, then inadvertently sent it to her office. Three other 6th Circuit Bush nominees from Michigan were confirmed by the Senate last year.
