With John Fisher, the longtime head of the appellate division of the U.S. Attorney’s Office in Washington, leaving shortly to join the D.C. Court of Appeals, U.S. Attorney Kenneth Wainstein has named Roy McLeese III as the division’s new chief. Excluding a brief stopover in the Solicitor General’s Office, McLeese has been a member of the office’s appellate division for the past 15 years. Most recently, he served as a deputy chief. “No one will be able to replace John, he is an institution around here,” McLeese says, “but I am looking forward to the opportunity.” When asked how it will feel the first time he argues in front of his old boss, McLeese says it won’t happen for a few years, since Fisher will recuse himself from any cases brought by the office during his tenure. The scenario is not without precedent. “John is following in the footsteps of all of his predecessors,” McLeese says, citing former appellate chiefs turned appellate judges John Terry and Michael Farrell.
