Most of official Washington spent last week focused on the nomination of Harriet Miers to replace Supreme Court Associate Justice Sandra Day O’Connor. But at least a few D.C. lawyers were also thinking about who might be tapped to replace Miers as White House counsel. According to several sources with close ties to the White House, two top contenders are Robert McCallum Jr., President George W. Bush’s college roommate, and Brett Kavanaugh, White House staff secretary and a Bush nominee to the D.C. Circuit. For McCallum, a complicating factor is the leadership void his departure would create at the Justice Department, where he currently serves as both associate AG and acting deputy AG. For Kavanaugh, the big question is whether he would have to withdraw his bid for a seat on the appellate bench. Other possible candidates for the influential post include Miers’ deputy William Kelley; former deputy White House counsel David Leitch; and former domestic policy adviser Jay Lefkowitz.
