Embattled contractor Custer Battles LLC changed lawyers last week as a False Claims Act suit against the McLean, Va.-based company entered the discovery phase. The security contractor was sued last year by two whistle-blowers, who charged it with defrauding the Coalition Provisional Authority in Iraq out of millions of dollars through the use of sham companies and faked receipts. Stepping aside as lead counsel are Fried, Frank, Harris, Shriver & Jacobson’s John Boese and Richard Sauber. Taking their place is Robert Rhoad, a partner in the D.C. office of Columbus, Ohio-based Porter Wright Morris & Arthur. Rhoad is a former U.S. Navy judge advocate general and an old friend of Custer Battles co-founder Scott Custer from their undergraduate days at the University of Vermont. “The match with our firm is just better for this stage,” says Rhoad. Boese says that Fried, Frank will continue to assist with the case, but declines to comment on reasons for the change. � Jason McLure
