In a 5-3 ruling, the Supreme Court on Wednesday told California to re-evaluate its policy that segregates new prisoners by race. Even in prisons, Justice Sandra Day O'Connor wrote for the majority, racial distinctions can survive only by meeting the toughest "strict scrutiny" standard. Chief Justice William Rehnquist, who missed oral arguments, did not vote in the case.
