I realize your BAR-ometer is a somewhat tongue-in-cheek editorial vehicle for those readers who need a hit of morning bar gossip. Nonetheless, I can’t let pass the downward pointing arrow and accompanying comments concerning John Keker’s performance in the Frank Quattrone case. [ Sept. 10 BAR-ometer] If there ever was a situation where the arrow should be pointing straight up, Keker’s defense of Quattrone is it. Faced with a judge who was contemptuous of the rule of law, the defendant, and defense team, and who ruled repeatedly and erroneously against Keker at every turn, Quattrone still got a hung jury in the first trial. His conviction in the re-trial was hardly a function of bad lawyering, but instead reflected the even more sharply honed efforts of the trial judge to ensure a conviction. The fact that Quattrone got 18 months is hardly surprising given the judge’s view of the case. That Keker stood up to the judge at every turn reflects the highest level of performance by an eminent criminal defense attorney, a view which I suspect is shared by Mr. Keker’s client.
