(7 pp.) Trial court, ruling in a contract suit, erred in holding that a house was built according to architect’s plan, since plaintiff builder did not locate house and driveway according to plan as defendant homeowner required. FAMILY LAW 20-2-4144 Stefan Rydzaj v. Anastazja Rydzaj, App. Div. (4 pp.) Where husband sued to terminate alimony payments, trial court erred in continuing the payments at a reduced rate, since the husband proved changed circumstances because he was on public assistance after being injured in an automobile accident. WORKERS’ COMPENSATION – NEGLIGENCE 25-2-4145 Susan Perez and Luis Perez v. George Athans, et al., App. Div. (9 pp.) Where plaintiff, a motel clerk, sued defendants, a motel chain and its managers, for sexual assault, trial court properly held that clerk could not sue under a common-law negligence claim, since the clerk could only file a workers’ compensation claim because the incident arose out of the course of her employment. CRIMINAL LAW AND PROCEDURE 14-2-4146 State v. Chance Venable, App. Div. (22 pp.) Where defendant was convicted of aggravated manslaughter, trial court properly admitted into evidence letters written by defendant’s brother after a Rule 8 hearing, since the letters were relevant to test defendant’s credibility.
