(26 pp.) Where newspaper sued city to obtain access to gun permit files, appellate court held that the records were not for public review, since (1) disclosure of the information would harm public interest under N.J.S.A. 2A:84A-27(b), and (2) “a common law balancing of public interest test requires” the documents’ protection. TORTS – REAL ESTATE 36-2-3934 Marcelino Saldana, et al. v. Leonard J. DiMedio and Walter Richardson, and the City of Camden, App. Div. (23 pp.) Where plaintiff property owners sued city officials and the city to recover for damage to their property caused by fires set in the city’s abandoned buildings, trial court erred in dismissing the complaint, since a fact issue existed as to whether defendant landowners negligently maintained the buildings in a dangerous condition. CRIMINAL LAW AND PROCEDURE 14-2-3935 State v. Benito Delmonte, App. Div. (4 pp.) Where defendant pled guilty to possession of a controlled dangerous substance, trial judge erred in not informing the defendant, prior to sentencing, of the maximum possible prison term the defendant faced; the matter is remanded.
