Defendants had served on plaintiffs a response to Notices of Settlement of Judgment, contesting the propriety of entry of judgment on the account stated claims. That document, however, was not received by the court before the judgments were signed. The court rejected the objections of defendants to entry of the final judgments on the account stated claims pursuant to Rule 54(b) and determined that there is no just reason for the delay of entry of the judgments. The court also amended the judgments to reflect the federal rate of post-judgment interest pursuant to 28 USC 1961(a). The court denied defendants’ motion to vacate the prior judgment for plaintiffs but granted defendants’ motion to amend the judgment and reopened the case.
