in a case against an anesthesiologist and his practice, the estate of a girl who died during an elective surgery was awarded $14.5 million by an Alabama jury on June 23. In 1998, Brandi Timmons, 17, went to Baptist East Medical Center in Montgomery, Ala., for surgery to correct an overbite. Timmons was anesthetized, became briefly responsive after surgery, but later went into cardiac arrest. Her estate sued the anesthesiologist, William Ware; the certified registered nurse anesthetist, Lil Hayes; and their employer, Anesthesiology & Pain Medicine of Montgomery. At trial, Timmons’ estate claimed that the defendants negligently administered too strong a dosage of anesthetics and withdrew a breathing tube prematurely. The defendants argued that they met the standard of care. Estate of Timmons v. Anesthesiology & Pain Medicine of Montgomery, No. CV-99-2769 (Montgomery Co., Ala., Cir. Ct.). PLAINTIFF’S ATTORNEYS: Joseph “Buddy” Brown Jr., Gregory B. Breedlove and David G. Wirtes, Cunningham, Bounds, Yance, Crowder & Brown, Mobile, Ala. DEFENSE ATTORNEYS: Randal H. Sellers and Walter William Bates, Starnes & Atchison, Birmingham, Ala.; Donald R. Jones Jr., Montgomery, Ala.
