in a unanimous decision, the justices affirmed the 1st U.S. Circuit Court of Appeals’ reversal of a Maine federal court order preliminarily enjoining the implementation of a state statute that would reduce prescription drug prices for state residents by allowing the state to negotiate rebates with drug manufacturers. Pharm. Research and Mfrs. of America v. Walsh, No. 01-188. The justices held that the petitioners had not met their burden of showing the probability of success on the merits of their claims. Stevens delivered the court’s opinion.
