in a unanimous decision, the justices upheld a decision by the 11th Circuit that affirmed a Florida federal court’s denial of a plaintiff’s motion to remand to state court a suit filed under the Federal Labor Standards Act. Breuer v. Jim’s Concrete of Brevard Inc., No. 02-337. The unpaid-wages claim had been removed to federal court by the defendant, who had been plaintiff Phillip T. Breuer’s employer. The justices held that the jurisdictional provision of the act did not bar removal of a suit to federal court because Congress had not expressly barred removal in the act. Souter wrote the court’s opinion.
