PREMISES LIABILITY a 10-year-old girl injured while guarding a school parking lot was awarded $167,434 by an Ohio jury on June 18. Tiffany Schenkenberger was guarding the lot at Pfeiffer Elementary School in Akron, Ohio. Her duties included raising and lowering a chain to let teachers in and keep parents out. When teacher Marina Beahn arrived, she drove over the chain while it was still in Tiffany’s hand, nearly severing one of the girl’s fingers. Carl Schenkenberger, on Tiffany’s behalf, sued Beahn and Akron City Schools Board of Education, claiming that Beahn negligently operated her car, and that the school was negligent for putting Tiffany in danger. The jury found Beahn 64% liable and the school board 36% liable. Schenkenberger v. Akron City Schools Board of Education, No. CV-2002-08-434 (Summit Co., Ohio, Ct. C.P.).
