SEXUAL ASSAULT a mentally retarded man who claimed that he was molested at a group home was awarded $540,000 for pain and suffering by a Florida jury on June 10. Mark Yellin, 28, was a resident of Victory Villas in Dania Beach, Fla. He claimed that his roommate and a visitor sexually molested him. He sued Victory Villas for negligence, alleging that the home knew that his roommate recently had been charged with sexually assaulting the 4-year-old daughter of another resident. Yellin claimed psychological and emotional injuries as a result of the incident. Victory Villas maintained that there was no physical evidence that Yellin had been sexually assaulted and maintained that records showed that he had never made any complaints of this nature other than of being teased. Yellin v. Victory Villas, No. 02-10553-03 (Broward Co., Fla., Cir. Ct.). PLAINTIFF’S ATTORNEY: Jeffrey M. Herman, Herman & Mermelstein, Hollywood, Fla. DEFENSE ATTORNEY: Jonathan C. Abel, Conroy, Simberg, Ganon, Krevans & Abel P.A., Hollywood
