MOTOR VEHICLE the estate of a man who was crushed between a wall and trailer at work was awarded $3 million-$1.5 million for each of his minor children-by a Florida jury on May 15. Hector Arostegui, 38, a laborer for Dino Di Milano Corp., was in a parking lot sealing the back of a trailer- load of textiles when Gustavo De Los Rios, a driver for Burgess Transport Inc., backed his tractor into the trailer to couple them. Arostegui’s estate alleged that De Los Rios failed to inspect the area before hooking them together, and that a combination of bad brakes and a negligent coupling procedure caused the trailer to move backward into Arostegui, killing him. His estate sued Burgess Transport and De Los Rios. The defense claimed that Arostegui’s and Dino Di Milano’s negligence caused the accident. Estate of Arostegui v. De Los Rios, No. 02-9134-CA-22 (Miami-Dade Co., Fla., Cir. Ct.). PLAINTIFF’S ATTORNEYS: Jeremy W. Alters and Stuart N. Ratzan, Ratzan & Alters, Miami; Kimberly Boldt, Angelo Barry & Boldt, Fort Lauderdale, Fla. DEFENSE ATTORNEYS: Edward R. Nicklaus and Steven W. Hyatt, Nicklaus & Hyatt, Coral Gables, Fla.
