During my more than 10 years as an appellate lawyer in private practice and two years as a federal appellate law clerk, I have read hundreds of appellate briefs that others have written.
One cannot read so many appellate briefs, drafted by so many different lawyers, without concluding that the average quality of appellate brief writing in the United States is far too low.
