A lawsuit brought by the estate of a woman who was injured in a car accident in Montgomery County but died in Philadelphia County will be tried in Montgomery County because venue is decided by the place where the fatal injury occurred not the place of death, the Superior Court ruled.
The ruling in Sunderland v. R.A. Barlow Homebuildersis one of first impression in Pennsylvania.
