A Lackawanna County trial judge has allowed plaintiffs in an asbestos case to move forward with punitive damage claims against two boiler manufacturers.

In a July 26 ruling, Lackawanna County Court of Common Pleas Judge Terrence R. Nealon said the plaintiffs in Horst v. Union Carbide sufficiently established factual issues as to whether the management of defendants Lennox Industries Inc. and Weil-McLain appreciated the risks of asbestos exposure and either acted or failed to act in conscious disregard of that risk.
