Defense lawyers are asking that former Judge Susan Forsling, who retired last year from Fulton County State Court, be reassigned to a case in which she had granted their client’s motion for summary judgment.
The ruling by Forsling, who is now a mediator and a senior judge, was overturned by the Georgia Court of Appeals in March. Now the lawyers for defendant LabCorp, a medical testing company accused of misreading the Pap smear of a woman who subsequently died of cervical cancer, argued that the case involves so many decisions Forsling already made that she should take it up to address the appellate court’s directions.
